Overview

These Terms of Service (“Terms”) apply to all use of the Blue Pulse website and associated online services operated by Blue Pulse Advanced Swimming Pool Engineering Limited, operating the online store under the brand name Blue Pulse (“we”, “us”, “our”).

By accessing or using our website, services or purchasing products, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use our services.

Our online store is hosted by Shopify, which provides us with the e-commerce platform used to operate our online store and provide our services.

  1. Access and Account

By using our services, you confirm that:

you are at least 18 years old, which is the age of majority in Ireland,

you are legally capable of entering into binding contracts,

any information you provide is accurate, complete and up to date.

You are responsible for safeguarding your account credentials. We are not responsible for any unauthorised activity on your account unless caused by our negligence.

We make reasonable efforts to ensure that product information is accurate and up to date. However:

colours and packaging may vary due to manufacturing changes or screen settings,

product availability and specifications may change without notice,

we reserve the right to limit quantities or discontinue items at any time,

technical information is provided for general guidance and should be checked against the manufacturer’s instructions where relevant.

Nothing in these Terms affects your statutory rights under Irish or EU consumer law.

  1. Orders

Placing an order constitutes an offer to purchase. An order is accepted only when you receive an order confirmation email from us.

We may cancel or amend an order if:

the item is unavailable,

payment cannot be processed,

there is a pricing or product information error,

fraudulent, abusive or suspicious activity is suspected,

delivery to the requested address is not possible or not commercially reasonable.

Returns, exchanges and refunds are governed by our Refund Policy.

  1. Prices and Billing

Prices are shown in Euro (€) and may include or exclude VAT depending on the product category, customer type and store settings.

By placing an order, you confirm that:

all billing information provided is accurate,

you are authorised to use the selected payment method,

your payment provider is authorised to charge the full order amount, including VAT, delivery charges and any applicable fees.

We may update product pricing at any time. Price changes do not affect orders that have already been accepted, except where there has been an obvious pricing error.

  1. Shipping and Delivery

Delivery times are estimates only and delays may occur due to courier operations, stock availability, weather, customs procedures or other circumstances outside our control.

Title and risk in the goods pass to you once the goods are delivered to the delivery address, unless otherwise required by applicable consumer law.

  1. Intellectual Property

All website content, including text, images, product descriptions, graphics, layout, logos and branding, is owned by Blue Pulse Advanced Swimming Pool Engineering Limited or its licensors.

“Blue Pulse” and related branding are used by Blue Pulse Advanced Swimming Pool Engineering Limited in connection with our online store and services.

We use Shopify as our e-commerce platform. However, all sales are made directly between you and Blue Pulse Advanced Swimming Pool Engineering Limited, operating under the brand name Blue Pulse.

Shopify provides the technical platform for our online store but is not responsible for product quality, product safety, shipping, returns, refunds, warranties or customer service relating to products purchased from us.

We do not guarantee that:

fraud or fraudulent misrepresentation,

breach of statutory consumer rights where such rights cannot be excluded,

any liability that cannot be excluded under Irish law.

You agree to indemnify Blue Pulse Advanced Swimming Pool Engineering Limited, its directors, employees and representatives against losses, claims, damages, costs or expenses resulting from your misuse of our services, breach of these Terms or violation of applicable law.

If any part of these Terms is found to be unlawful, invalid or unenforceable, that part will be treated as removed to the minimum extent necessary. The remaining provisions will continue in full force and effect.
