Overview

These Terms of Service (“Terms”) apply to all use of the BluePulse Shop website and associated online services operated by BLUE PULSE ADVANCED SWIMMING POOL ENGINEERING LIMITED, trading as BluePulse Shop (“we”, “us”, “our”).

By accessing or using our website, services or purchasing products, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Services.

Our online store is hosted by Shopify, which provides us with the e-commerce platform used to deliver our Services.

1. Access and Account

By using our Services, you confirm that:

  • you are at least 18 years old (age of majority in Ireland),
  • you are legally capable of entering into binding contracts,
  • any information you provide is accurate and complete.

You are responsible for safeguarding your account credentials. We are not responsible for any unauthorised activity unless caused by our negligence.

2. Our Products

We make reasonable efforts to ensure that product information is accurate. However:

  • colours and packaging may vary due to manufacturing changes or screen settings,
  • product availability and specifications may change without notice,
  • we reserve the right to limit quantities or discontinue items at any time.

Nothing in these Terms affects your statutory rights under Irish or EU consumer law.

3. Orders

Placing an order constitutes an offer to purchase. An order is accepted only when you receive an order confirmation email.

We may cancel or amend an order if:

  • the item is unavailable,
  • payment cannot be processed,
  • there is a pricing or product information error,
  • fraudulent or abusive activity is suspected.

Returns, exchanges and refunds are governed by our Refund Policy.

4. Prices and Billing

Prices are shown in Euro (€) and may include or exclude VAT depending on category and settings.

  • all billing information must be accurate,
  • you must be authorised to use the payment method,
  • your payment provider must honour all charges including VAT and delivery.

We may update pricing at any time.

5. Shipping and Delivery

Delivery times are estimates only and delays may occur. Title and risk pass to you once the carrier receives the shipment.

6. Intellectual Property

All website content is owned by BluePulse Advanced Swimming Pool Engineering Limited or its licensors. You may not copy, reproduce, modify or distribute any content without written permission.

“BluePulse Shop” and related branding are trademarks of BluePulse Advanced Swimming Pool Engineering Limited.

7. Optional Tools

We may provide access to optional third-party tools “as is”. Use of such tools is entirely at your own risk.

8. Third-Party Links

We are not responsible for the content, policies or availability of third-party websites linked from our site.

9. Relationship with Shopify

We use Shopify as our e-commerce platform, but all sales are made directly between you and BluePulse Shop. Shopify is not responsible for product quality, shipping, returns, refunds, or product safety.

10. Privacy Policy

Your personal data is processed according to our Privacy Policy. Because our store is hosted by Shopify, some data may be processed under Shopify’s policies.

11. Feedback and Reviews

By submitting reviews or feedback, you grant us a royalty-free licence to use them for marketing and business purposes.

12. Errors and Omissions

We may correct pricing or product information errors and update or cancel orders affected by such errors.

13. Prohibited Uses

You must not use the Services:

  • for illegal or fraudulent purposes,
  • to violate any applicable laws,
  • to infringe intellectual property or privacy rights,
  • to upload viruses or harmful code,
  • to harass, threaten or harm others.

14. Termination

We may suspend or terminate access if:

  • you breach these Terms,
  • fraudulent or abusive activity is suspected,
  • termination is required to protect systems or customers.

You remain responsible for fees accrued up to the date of termination.

15. Disclaimer of Warranties

The Services and products are provided “as is” and “as available”. We do not guarantee that:

  • the website will be uninterrupted or error-free,
  • defects will be corrected immediately,
  • all product information will always be up to date.

Nothing in these Terms affects your statutory consumer rights.

16. Limitation of Liability

To the fullest extent permitted by law, we are not liable for:

  • indirect or consequential loss,
  • loss of profit, revenue, data or business,
  • damage caused by courier delays or misuse of products.

We do not exclude liability for:

  • death or personal injury caused by negligence,
  • fraud or fraudulent misrepresentation,
  • any liability that cannot be excluded under Irish law.

17. Indemnification

You agree to indemnify BluePulse Shop and its employees against losses resulting from your misuse of the Services.

18. Severability

If any part of these Terms is found unenforceable, the remaining provisions remain valid.

19. Waiver and Entire Agreement

These Terms, together with our Policies, form the entire agreement between you and BluePulse Shop.

20. Assignment

You may not transfer your rights without our consent. We may transfer our rights at any time.

21. Governing Law

These Terms are governed by Irish law. Disputes are subject to the exclusive jurisdiction of Irish courts.

22. Changes to These Terms

We may update these Terms periodically. Continued use of the Services constitutes acceptance of changes.
